1. Scope of validity
These General Terms and Conditions (GTC) apply to all contracts, bookings, enquiries and other services between SWBC GmbH (hereinafter "SWBC") and users of the swbc.ch website.
2. Contract partners
The contract is concluded with SWBC GmbH. Further information can be found in the imprint.
3. Contract conclusion
By submitting an order, booking or enquiry through the website, the customer makes a binding offer. A contract is concluded when SWBC confirms the order, booking or enquiry by e-mail.
4. Prices and costs
Prices stated on the website include VAT where applicable. Additional costs are shown before completion of a paid offer.
5. Terms of payment
Payment is made by invoice, bank transfer or the payment method offered in the relevant booking or order process. Invoice amounts are due without deduction.
6. Delivery and performance of services
Digital or event-related services are provided according to the relevant service description. If a service is not available, SWBC informs the customer in a timely manner.
7. Cancellation and withdrawal
Where statutory withdrawal rights or contractual cancellation terms apply, the terms stated in the relevant offer apply. Events may be subject to separate cancellation periods.
8. Warranty
Statutory warranty rights apply unless they have been validly limited. Defects must be reported to SWBC as soon as possible.
9. Liability
SWBC shall be liable without limitation for intent and gross negligence. SWBC shall only be liable for simple negligence in the event of a breach of material contractual obligations (cardinal obligations), whereby liability shall be limited to the foreseeable, typically occurring damage.
10. Privacy policy
Personal data is collected, processed and used in accordance with our privacy policy. This can be found under privacy policy.
11. Applicable law
Swiss law shall apply to all disputes arising from or in connection with the contract, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
12. Final provisions
Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. In place of the invalid provision, the valid provision that comes closest to the economic purpose of the invalid provision shall be deemed to have been agreed. Amendments and supplements to these GTC must be made in writing.
