General Terms and Conditions
1. Scope of validity
These General Terms and Conditions (GTC) apply to all contracts, deliveries and other services between SWBC GmbH (hereinafter ‘SWBC’) and the users (hereinafter ‘Customer’ or ‘Customers’) of the swbc.ch website (hereinafter ‘Website’).
2. Contract partners
The purchase contract is concluded with SWBC GmbH. Further information can be found in our imprint.
3. Contract conclusion
By submitting the order on our website, the customer makes a binding offer to conclude a purchase contract. The purchase contract is concluded when SWBC accepts the customer's order by sending an order confirmation by e-mail.
4. Prices and shipping costs
The prices stated on the website are inclusive of VAT. In addition to the prices stated, shipping costs may be incurred, which will be expressly communicated before the order is finalised.
5. Terms of payment
The customer can make payment by [bank transfer, credit card, PayPal, etc.]. The invoice amount is due immediately and payable without deduction.
6. Shipment
Delivery is made to the delivery address specified by the customer. The delivery time is approx. 5 working days from conclusion of the contract. If an item is not available, the customer will be informed immediately.
7. Right of cancellation
Consumers have a 14-day right of cancellation. Further information on the right of cancellation can be found in our cancellation policy.
8. Warranty
The statutory warranty rights shall apply. In the event of defects in the delivered goods, the customer has the right to demand subsequent fulfilment (rectification of defects or replacement delivery). If the subsequent fulfilment fails, the customer may reduce the purchase price or withdraw from the contract.
9. Liability
SWBC shall be liable without limitation for intent and gross negligence. SWBC shall only be liable for simple negligence in the event of a breach of material contractual obligations (cardinal obligations), whereby liability shall be limited to the foreseeable, typically occurring damage.
10. Privacy policy
Personal data is collected, processed and used in accordance with our privacy policy. This can be found under privacy policy.
11. Applicable law
Swiss law shall apply to all disputes arising from or in connection with the contract, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
12. Final provisions
Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. In place of the invalid provision, the valid provision that comes closest to the economic purpose of the invalid provision shall be deemed to have been agreed. Amendments and supplements to these GTC must be made in writing.
